CarGurus Named in NYC Pricing Suit

A city consumer agency has decided a marketplace's price badge counts as an advertising claim. That puts dealer fee structures into the evidence file of a lawsuit they are not even named in. CBT News and Yahoo Finance cover New York's suit against CarGurus over its "Great Deal" ratings, built around a Honda listing. The Minnesota Automobile Dealers Association has the date for the federal fuel economy rollback, Automotive Dive has Volkswagen's widened ID.4 recall, and Automotive News Canada has Unifor's strike vote against Stellantis. Smaller items on buy-sell, auction and vendor moves round out the wire. None of it changes what is due on a dealer's own listings this week.

Questions from this episode

Why did New York City sue CarGurus?

New York City's Department of Consumer and Worker Protection sued CarGurus in New York County Supreme Court, alleging its "below market" savings figures and "Great Deal" ratings hide mandatory fees in fine print. The lead example in the complaint is a Honda listing rated $2,212 below market that, once fees were applied, was actually $1,473 above market.

How is New York treating CarGurus' price badge in the lawsuit?

The city is treating the "below market" savings badge as an advertising claim in its own right, under three causes of action pled under the city's consumer protection law. CarGurus says it rejects the allegations and will defend itself.

When does NHTSA's CAFE rollback take effect?

The rollback of CAFE fuel economy standards takes effect November 30. It cuts the 2031 fleet target from 49.3 miles per gallon to 34.9, with the agency projecting about $1,290 off average vehicle cost.

What did the FTC find in its settlement with Greenway Auto Group?

The FTC's settlement with Greenway Auto Group found that customers paid an average of more than $3,350 above advertised price, happening in over 92% of transactions. The case followed a warning letter from the FTC that the agency says went unheeded.
